Things to consider when choosing an attorney:

When choosing an attorney it’s important to do your research, and get to know the attorney and firm that could be handling your car accident, slip and fall, medical malpractice, or other serious injury case. While there are many things to consider when researching your potential lawyer, we’ve outlined the 3 most important things to consider.

Availability & How often you and your attorney will speak

One of the most important things to keep in mind, is the availability of your lawyer and how often the lawyer will be able to speak with you about your case. In addition to speaking with the attorney, you may speak with a paralegal or other members of the firm. Its important when choosing a Personal Injury Lawyer to work with, you should consider the case load, size of the firm, and online reviews to help determine their responsiveness to clients.

Experience of the lawyer & law firm

In addition to a lawyer who is available to speak with you, its important to find an experienced attorney. You want to find a knowledgeable attorney who will not only fight for the highest settlement for you, but also is reputable and respected in and outside of the courtroom.

The cost

Most personal injury attorneys work on what’s called a contingent fee. What this means is that there is no upfront or out of pocket cost, and the attorney only profits if they are successful in getting you a settlement. For personal injury, the average attorney charges 33%, with others reaching as high as 44% of YOUR settlement.

At My25% Lawyer, our Experienced attorneys are available to speak with you 24/7. In addition we have one of the lowest pre-litigation & litigation contingent fee of ONLY 25%

Recent Recalls & What to do

Faulty products may cause serious injury. It is the manufacturer’s responsibility to ensure the product is designed and created without any defects that may injure the consumer. It’s important to stay up to date with current recalls, as they are typically household products or car parts. Below is a list of a few recalls from www.recalls.gov

If you or someone you know has been injured due to a faulty product, it is important to seek medical attention and consult with a lawyer.

Consumer Product Recalls

FDA Recalls

Vehicle Recalls

Child Safety Seat Recalls

If you have been injured due to a product malfunction, seek medical attention and consult an attorney.

What to know when it comes to Product Liability

Product Liability occurs after someone purchases or uses a product, which causes an injury or bodily harm due to the product being defective. This defect is not caused by user error or damage, but by the manufacturer before the product is sent to the consumer. When product liability occurs, certain pieces of the product may be faulty. When a product defect causes you or your family injury, the company that produces the product may be liable to compensate you for your injuries. Depending on the product, different parties could be responsible for the defective product. It’s important to have an experienced attorney on your side, to ensure you pursue everyone responsible for your injuries.

For a product liability case, it is imperative that the product was defective due to a manufacturing error. In addition, if you are injured by a product (which could be anything from a kitchen appliance to a hearing aid or medical device), save your proof of purchase and, the faulty product. This will aid your case. Injury from a product may not seem very severe at first, but it is important that you seek medical attention immediately if injured due to a product you purchased or used.

How to properly prepare for an accident in Atlanta

Whether you own a rust bucket with 100,000 miles on it or a shiny new car that is equipped with all of the latest technology, you take a gamble every time you drive in Atlanta. Auto accidents and other emergencies happen all of the time. You need to prepare for it.

The best way to prepare for an emergency is to properly stock it. Here, we suggest that you keep this short list of basic items in your car at all times:

After being escorted to a safe location contact an emergency contact to report your location and proceed to the closest urgent/emergency care room if in pain. Understand that after an accident the human body will compensate with an adrenaline rush causing what’s called “dopamine” to lessen the body’s pain. At any point in this process you can reach out to us here at Dimmock and Associates to guide you through the process with a compassionate ear and expert legal advice.

The number of traffic deaths in Georgia dropped for the last few years, according to the 2018 Fatal Motor Vehicle Crashes report released by the National Highway Traffic Safety Administration (NHTSA).

According to NHTSA’s Fatality Analysis Reporting System (FARS), Georgia’s 1,504 traffic deaths in 2018 represents a 2.3 percent decrease from the 1,540 traffic deaths in 2017. This is the biggest drop in Georgia’s traffic deaths since 2012 when the 1,192 traffic deaths was 34 less than the 1,226 in 2011.This report is further proof the Hands-Free Law is working and we need to continue our enforcement and education efforts to get all drivers to comply with the law.

Another sign of the effectiveness of Georgia’s Hands-free law enacted last was drop in passenger vehicle fatalities last year.  There were 994 passenger vehicle fatalities in Georgia in 2018 which is a six percent drop from the 1,056 that happened in 2017.  It is also the first time since 2014 (795) that Georgia recorded less than 1,000 passenger vehicle fatalities.

The decrease in Georgia matches a similar nationwide decrease last year. According to NHTSA, there were 36,560 traffic deaths nationwide in 2018, which is 2.4 percent less than the 37,473 reported in 2017.

While the total number of Georgia traffic deaths has decreased for two straight years, the number of pedestrian deaths in the state has gone up for a third straight year. There were 261 pedestrian fatalities in 2018, which is eight more than the 253 that occurred in 2017. Pedestrian deaths in Georgia have increased by 60 percent over the last five years. Understand when accidents occur we hope for the best outcomes, at Dimmock and Associates we can guide you through the process of assisting you with investigating the cause of any accidental death caused by negligent behavior.

Have you ever been apart of a Public Transportation / Ride Sharing / Uber, Lyft, and or Taxi Accident?

When you are injured as a passenger of a taxi or as a client of a Transportation Network Company (TNC), e.g., Uber or Lyft, you deserve fast and fair compensation.  As a rider/passenger of one of these for profit transportation companies, you need accountability and transparency during the claims process. Unfortunately, that is easier said than done!  Commercial insurance carriers are not in the business of paying out money and they do not want to set precedent that they pay out large sums to accident claimants. This is why you need to hire a reputable law firm with experience in representing clients who have been injured in accidents related to commercial transportation services.

The involvement of another corporate entity in a commercial transportation accident case causes the accident claims process to be more complex than in the case of a typical auto accident.  Since these transportation companies are providing commercial services to the consumer public, their insurance requirements are different than standard personal auto policies. To be able to effectively submit, manage and recover under such commercial insurance policies requires the experience and confidence of an aggressive personal injury law firm.  However, to recover maximum compensation under such insurance policies requires even more – it requires an exceptional law firm dedicated to consumer justice.  We have obtained maximum policy settlements for clients on numerous commercial transportation cases involving taxi companies and TNCs, and we will do the same for you.  We know how to properly set up, manage and document cases so that the insurance companies understand the full effect of resulting injuries on your life and well-being.

At Dimmock and Associates, we have handled many claims involving Uber and Lyft passengers and drivers, and we are intricately familiar with their insurance requirements and claims processes. We know how the interplay of the third party driver’s insurance company, the TNC’s insurance company, and your own insurance company have to be strategically manipulated in order to maximize your personal injury case.

Sometimes, due to overlapping insurance policies, liability is aggressively contested by the applicable commercial insurance carriers.  The challenge then becomes to identify the responsible parties and apportion fault to the appropriate drivers, as applicable.

When we see a character slip and fall down in a movie or on TV, it can just as easily be for comedic effect as it can be for demonstrating any danger. However, in the real world slip and falls are anything but a laughing matter. In the real world, keeping a property free of the types of dangers that can result in a slip and fall (or other type of accident) is not just a good idea but a legal responsibility that is too often not taken seriously.

When someone slips and falls down in a supermarket because of a spill, or tumbles down poorly designed stairs, the accidents are called “premises liability cases” and can entitle the victim to serious compensation for the injuries they received. It’s for this reason that it is extremely important to have a skilled attorney on your side if you are ever hurt on someone else’s property, in order to make sure that the owner(s) is held to the exacting standards of the law in how safe they need to make their property.

Premises liability cases can be very complicated and cover a huge variety of accident types. Dog bites, insufficient security, and pool accidents are just some examples of the wide variety of incidents that fall under the same umbrella of the law. Beyond just the type of accident, the type of property makes a difference. Premises liability cases can happen on public property (like a city park), private property (like a person’s home), or even a workplace. In addition, the relationship of the injured party to the property makes a difference in establishing the owner’s liability. A person who was invited onto the property or who is contracted to work there is more protected under the law than someone who is there without permission, but it’s important to note that even if you are on someone else’s property without their permission, you still have protections under the law if you are injured.

In a premises liability case, the victim has to show the court that the property owner’s negligence played a role in contributing to the accident that caused the injuries. This might mean that the owner failed to repair something that was damaged and posed a hazard, or that other people had previously been hurt in the same way but the owner never did anything to prevent future injuries. Since this can sometimes be difficult to prove, testimony from the victim and any potential witnesses is extremely important. Since people’s memory of events can become cloudy as time passes, it is critical that if you are injured on someone’s property you contact Dimmock and Associates right away who specializes in premises liability cases who can immediately get to work on your case.
